100PLUSANIMALRESCUE, INC., et al., Plaintiffs, v. Darcy Ode BUTKUS, Defendant Case No. 17-61893-CIV-ROSENBERG/HUNT United States District Court, S.D. Florida, Fort Lauderdale Division Signed January 11, 2023 Counsel Lorne Adam Kaiser, Kaiser Romanello, P.A., Parkland, FL, for Plaintiffs. Thomas Lee Hunker, Virginia Ashley Paxton, Hunker Appeals, Fort Lauderdale, FL, Todd Richard Dobry, Jackson Lewis P.C., Jacksonville, FL, for Defendant. Hunt, Patrick M., United States Magistrate Judge ORDER *1 This matter is before this Court on Defendant's Motion for Limited Damages Discovery, ECF No. 250, and Plaintiffs’ Motion to Compel Responses to Financial Worth Discovery, ECF No. 256. The Honorable Robin L. Rosenberg referred both motions to the undersigned for appropriate disposition. ECF No. 259; see also 28 U.S.C. § 636; S.D. Fla. L.R., Mag. R. 1. Upon thorough and careful review of the record, the applicable law, arguments of counsel at the January 6, 2023 hearing, and being otherwise fully advised in the premises, the undersigned GRANTS Defendant's Motion in part and DENIES Plaintiffs’ Motion to Compel as moot for the reasons set forth below. Prior to the January 6, 2023 hearing on the Motions, Defendant served responsive documents to Plaintiffs’ financial discovery requests. Counsel for Plaintiffs confirmed receipt of the responses. Therefore, Plaintiffs’ Motion to Compel is now moot and is denied as such. However, due to the lateness of the response, Plaintiffs requested a brief enlargement of time within which to complete the financial worth deposition previously ordered to be completed by January 13, 2023. The undersigned grants Plaintiffs’ request and the deadline to complete the financial worth deposition is now January 20, 2023. Regarding Defendant's Motion for Limited Discovery, the undersigned explained during the motion hearing that the Court was not going to reopen discovery and allow a third deposition of Plaintiff Amy Roman. However, the Court further explained that it may be inclined to allow written discovery on the limited issue raised. The Court ordered the Parties to confer and agree to language on the limited issue. The Parties have done so and have filed a notice of the agreed language, ECF No. 270, which is incorporated below. Based on the foregoing, it is hereby ORDERED AND ADJUDGED that Plaintiff's Motion to Compel, ECF No. 256, is DENIED as moot. However, the deadline to complete the financial worth deposition is now January 20, 2023. It is further ORDERED that Defendant's Motion for Limited Damages Discovery, ECF No. 250, is GRANTED in part as follows: The Plaintiffs, 100PlusAnimalRescue and Amy Roman, shall produce all documents, communications, and/or correspondence in their possession, custody, or control that have been exchanged, communicated, intended for, transferred, or sent to or received between or from them, individually or collectively, and/or Sunbeam, Sunbeam Television Corporation d/b/a WSVN7, WSVN7 and/or any and all of its representatives, agents, employees, affiliates, custodians, information keepers, retainers, and/or attorneys, paralegals, or staff, in both their individual and representative capacities, concerning, related to, reflecting, and/or mentioning in any way the Florida Department of Agriculture, its investigation of 100PlusAnimalRescue, and any related findings. Discovery is deemed open for the limited purpose of requiring Third-Party Sunbeam Television Corporation d/b/a WSVN7 to respond to Defendant's third-party request for production within the same scope as permitted in this order concerning Defendant's discovery requests to Plaintiffs. *2 Defendant must complete this discovery no later than January 20, 2023. This Order does not modify any other deadlines set forth by the District Court and is subject to any additional deadlines the District Court may set. DONE and ORDERED at Fort Lauderdale, Florida this 11th day of January 2023.
