The following motion is before the Court: Defendants' Motion to Compel Discovery Regarding AT&T Documents (Docket Entry #s 327, 105, 110, 105). The Court, having reviewed the relevant briefing, is of the opinion the motion should be DENIED. Defendants Ericsson Inc., Telefonaktiebolaget LM Ericsson, AT&T Mobility LLC, MetroPCS Communications, Inc., T-Mobile USA, Inc., Cellco Partnership d/b/a Verizon Wireless, and Sprint Spectrum LP (“Defendants”) move the Court to compel Adaptix, Inc. (“Adaptix”) to search all potential sources for native versions of AT&T documents, and once found, make the native versions and metadata associated with those documents available to Defendants' forensics expert. According to Defendants, this information is relevant to Defendants' defenses of unclean hands and derivation and is in Adaptix's possession. In the event Adaptix maintains this evidence no longer exists, Defendants request Adaptix be ordered to account for its disappearance or destruction. After Defendants filed their current motion, District Judge Schroeder entered an order in a related case rejecting Defendants' argument that Adaptix derived the invention from the AT&T Project Angel documents. See Cause No. 6:12cv22 (Docket Entry # 567). And more importantly, the Court notes Adaptix's representation that it “has searched all sources of data at its disposal for the native AT&T documents and their metadata,” including the Adaptix and Acacia servers, “whose complete contents, including all native documents, were uploaded to Adaptix's Relativity database in 2013.” (Docket Entry # 341 at 3). According to Adaptix, the only data repository where any version of the AT&T documents or any metadata associated with those documents has ever been located is the Ware hard drive, and despite months of forensic inspection, no native versions of the AT&T documents were found. Adaptix further asserts all metadata information associated with the AT&T documents that has been located has been produced to Defendants. Accordingly, it is ORDERED that Defendants' Motion to Compel Discovery Regarding AT&T Documents (Docket Entry #s 327, 105, 110, 105) is DENIED. SIGNED this 16th day of December, 2015.
